End‑User License Agreement (EULA) for LinkEase

1. Acceptance of Terms

By downloading, installing, accessing, or using LinkEase (the “App”), you (“User”) agree to be bound by this End‑User License Agreement (“EULA”). If you do not agree, do not use the App.

2. Eligibility – Minimum Age 14

The App may not be used by anyone under fourteen (14) years of age. We do not accept parental consent as a substitute for this minimum age.

3. Account Registration & Deletion

You must create an account (“Account”) to use the App. When registering, you agree to:

  • Provide accurate, current, and complete information (including your real name and age);

  • Keep your credentials confidential and secure; and

  • Delete your Account only through in‑app settings → Delete Account. Deletion is immediate, though residual data may persist up to 90 days in back‑ups (see § 7).
    Re‑creating an Account with the same credentials within the retention window will reactivate prior data.

4. Licence Grant

Subject to your compliance with this EULA, LinkEase LLC (“Company,” “we,” “us,” or “our”) grants you a limited, non‑exclusive, non‑transferable, revocable licence to install and use one copy of the App on a device you own or control for personal or internal business purposes.

5. Licence Restrictions

You must not:

  1. Reverse‑engineer, decompile, or disassemble the App except where such restriction is prohibited by applicable law.

  2. Sell, lease, sublicense, distribute, or otherwise transfer the App or any rights therein.

  3. Infringe intellectual‑property or privacy rights.

  4. Use the App in a manner that harms, disables, or interferes with our systems.

6. Intellectual‑Property Rights

The App is licenced, not sold. All rights, title, and interest remain with Company or its licensors.

7. User‑Generated Content

You retain ownership of any content you submit (“User Content”). You grant Company a non‑exclusive, worldwide, royalty‑free, transferable, sub‑licensable licence to host, store, reproduce, adapt, publish, and display User Content solely to operate, improve, and promote the App. This licence survives for 90 days after account deletion for back‑ups and legal compliance.

8. Privacy

Our Privacy Policy (linkease.app/privacy) explains how we handle personal data and forms part of this EULA.

9. Updates & Material Changes

We may issue updates that add, change, or remove features. If an update materially reduces core functionality we will notify you at least 30 days in advance; you may terminate the licence and request a pro‑rata refund if you do not accept the change.

10. Disclaimer of Warranties

Except where prohibited by mandatory law, the App is provided “as is” and “as available.” Nothing in this EULA affects statutory warranties or remedies that cannot be excluded (e.g., EU Dir. 2019/770, UK CRA 2015).

11. Limitation of Liability

Nothing excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be limited. Subject to the foregoing, Company’s aggregate liability shall not exceed the greater of (i) the fees you paid in the previous 12 months or (ii) €50 / US$50, and Company is not liable for indirect or consequential damages.

12. User Interactions & Background Checks

You are solely responsible for your interactions with other users, both on‑ and offline. LinkEase does not conduct criminal background checks and makes no representations regarding user conduct. We reserve the right to conduct screenings at any time and to remove or ban users in our sole discretion.

13. Indemnification

You agree to indemnify Company only for third‑party intellectual‑property or privacy claims arising from your unlawful User Content or wilful breach of this EULA, except where such claims result from our negligence or misconduct.

14. Governing Law & Jurisdiction

This EULA is governed by Wyoming law and the mandatory consumer‑protection laws of your country of residence. You may bring proceedings in your local courts.

15. Third‑Party App‑Store Terms (Apple / Google)

  1. Acknowledgement – This EULA is solely between you and LinkEase, not Apple Inc., Google LLC, or any other app‑store provider.

  2. Maintenance & Support – Apple and Google have no obligation whatsoever to furnish any maintenance or support services. LinkEase is responsible for support.

  3. Product Warranties – To the maximum extent permitted by law, Apple and Google disclaim all warranties; any warranty obligation rests solely with LinkEase.

  4. Claims – LinkEase, not Apple/Google, is responsible for addressing any claims relating to the App or your possession and/or use of the App.

  5. Intellectual Property – In the event of a third‑party intellectual‑property claim, LinkEase (not Apple/Google) will be solely responsible for the investigation, defence, settlement, and discharge of such claim.

  6. Third‑Party Beneficiary – Apple, Google, and their affiliates are third‑party beneficiaries of this EULA and may enforce its terms against you.

  7. Compliance – You must comply with applicable third‑party terms of service (e.g., Apple Media Services Terms, Google Play Terms).

16. Zero‑Tolerance Policy & Content Moderation (Apple UGC Requirements)

LinkEase enforces a strict zero‑tolerance policy toward illegal or abusive content and behaviour.

  1. Automated Pre‑Filter – Machine‑learning classifiers block illegal imagery, hate speech, sexual exploitation, and malware links before publication.

  2. Real‑Time Human Moderation Queue – Suspicious or borderline content is held for manual review by trained moderators 24/7.

  3. User Reporting – Every post, profile, and message includes a Report button (harassment, hate, sexual, violent, illegal, spam). Reports hide content from the reporter immediately.

  4. User Blocking – You may block any user at any time. Blocked users cannot view your profile or contact you.

  5. Expeditious Action – We aim to review all reports within 24 hours and will remove confirmed objectionable content, disable accounts, and notify law enforcement where required.

  6. Repeat‑Offender Ejection – Repeated or egregious violators are permanently banned and device identifiers blacklisted.

  7. Appeals & Transparency – In‑app Appeals portal (Settings → Support → Appeals) lets users contest decisions; annual transparency reports published under the EU Digital Services Act.

Uploading or attempting to distribute objectionable content constitutes a material breach and may result in immediate termination without refund.

17. Termination

You may terminate by deleting the App and closing your account. We may terminate immediately for serious breach. Sections 6‑7, 10‑15, 16‑20 survive termination.

18. Severability

If any provision is invalid, the remainder shall remain in force, reflecting the parties’ original intent.

19. Entire Agreement

This EULA and the Privacy Policy constitute the entire agreement between you and Company regarding the App.
